Spoliation may become an issue in a case when evidence has been lost, tampered with, destroyed, or mutilated. A party may be sanctioned for spoliation of evidence whether the party acted in good faith, or was merely negligent in their actions. At this session our speaker will discuss the Rhode Island case law and jury instructions regarding this issue.
